Governing Law

These terms shall be governed by and construed in accordance with the laws of the Republic of Ghana.

1. Nature of Service

HyperBook is an AI-powered study companion designed to act as a practice tool to help improve grades. It is not a replacement for official academic instruction. While we strive to help you succeed, prepare, and identify gaps in knowledge, the responsibility to pass official examinations lies solely with the student.

2. AI Disclaimer

Our content is generated by Artificial Intelligence. While highly advanced, AI can occasionally make errors. The app and its content are provided "as is." We do not guarantee 100% accuracy of generated questions or grading.

3. User Conduct & Account Security

Session Enforcement: To protect account security, we enforce a "Single Device" policy. Logging in on a new device will automatically terminate any active session on other devices.
Prohibited Content: You strictly may not upload content that is violent, sexual, illegal, or hateful. We reserve the right to block such content and report serious incidents to relevant authorities.

4. Fair Use & Rate Limiting

To ensure the stability of our AI systems and encourage genuine study habits, we enforce rate limits on content generation:

Discretionary Limits: We reserve the right to limit the number of pages you can upload per day.
Performance-Based Throttling: Rate limits may vary based on student performance to encourage healthy review habits. Accounts found to be abusing the system to overwhelm our servers will be suspended.

5. Subscription, Credit Bank, and Data Access

Premium features are managed via a "Credit" system. By purchasing or using Credits, you agree to the following funding and access scheme:

5.1 Rationale for Subscription

Every study material uploaded to HyperBook requires significant, ongoing computational power. Our AI servers perform complex Optical Character Recognition (OCR), handwritten text analysis, and Large Language Model (LLM) processing for every single page. Because these operations incur substantial direct costs per request, we require a monthly subscription to maintain the service and ensure the highest quality AI evaluations for every student.

5.2 The Credit Standard

One (1) Credit Point is equivalent to one (1) full calendar month of Premium Access for one (1) student account. Credits are digital tokens used to offset the processing costs mentioned in section 5.1.

5.3 Parent "Credit Bank" Role

Parent accounts serve as administrative and funding hubs. Parent accounts do not consume credits. Parents purchase credits to hold in a "Credit Bank" for distribution to one or more linked student accounts. A single parent can fund multiple students using this central bank.

5.4 Student Consumption

When a Student account holds a credit balance, the system will automatically consume one (1) credit to renew access if the current subscription is expired or expiring within 48 hours.

5.5 Permanent Access to Past Data

Mock exams, results, and AI corrections generated during a period of active premium access are permanently available for review. A student does not need an active subscription to view their past questions and feedback; active premium access is only required to generate new goals and mock exams.

5.6 Payments & Refunds

Payments made via third-party gateways (e.g., Paystack) or App Stores are subject to their respective terms. Credits are considered digital goods; once transferred or consumed, they are non-refundable unless required by local law.
